• Draft Electronic Communication Bill
  The British Department of Trade and Industry has published a draft Electronic Communication Bill. The aim of the bill is to strengthen the confidence in E-Commerce and to improve the relations of citizens with the administration via the Internet.

• Projet de loi relatif au commerce électronique

  Le Ministère de l'Economie vient de présenter sur son site le projet de loi relatif au commerce életronique. Celui-ci se base sur l'avant-projet de loi réalisée à la demande de l'ABBL par la LDE, CRPGL et le CRID de Namur, qui a pris en compte d'une part les législations en vigueur à l'instar de la loi allemande de 1996 et d'autre part, les propositions communautaires, notamment la proposition de directive sur la signature électronique. De même, les rédacteurs de l'avant-projet ont procédé à la transposition des directives en vigueur, que ce soit la directive 97/7 CE sur la protection des consommateurs en matière de contrats à distance ou celle relative à la protection des données (97/77 CE).

• Referentenentwurf Fernabsatzgesetz (FernAG)
  Der Gesetzentwurf des Bundesministeriums der Justiz soll die EG-"Fernabsatzrichtlinie" vom Mai 1997 in nationales Recht umsetzen. Er sieht Verbraucherschutz vor allem durch umfassende Informationspflichten der Unternehmen und Widerrufsrechte der Verbraucher vor. Als Fernabsatz-Vertriebstechniken sind Vertriebswege erfaßt, die sich ausschließlich auf Briefe, Telefon, Telefax, e-mail, Internet, Videotext oder vergleichbare Medien stützen.
  Der Entwurf enthält ferner Regelungen über unverlangte Warensendungen, unerbetene Werbung und über die Freistellung des Verbrauchers beim Mißbrauch einer Kredit- oder EC-Karte.

• Commission proposal for European Parliament and Council Directives on certain legal aspects of electronic commerce in the internal market
  The proposed Directive would ensure that information society services benefit from the Single Market principles of free movement of services and freedom of establishment and that they could provide their services throughout the European Union (EU) if they comply with the law in their country of origin. Such services are defined as those provided normally against remuneration, at a distance, by electronic means and in response to the individual request of a customer. • Commission proposal for European Parliament and Council Directives on the taking up, the pursuit and the prudential supervision of business of electronic money instituions
  By harmonising minimum rules for ensuring that institutions issuing electronic money are stable and sound, the proposals would promote confidence amongst business and consumers. They would therefore facilitate the development of electronic commerce within the EU and make it easier for consumers to use electronic money to make small payments in euros in other Member States without having to convert national currencies, notably during the period before euro notes and coins are introduced.
